3 March 2023 – Today, 3 March 2023, the European Commission (EC) announced the results of its investigation into anti-fraud R777 in relation to Malaysian stainless steel. The investigation concluded that certain stainless steel pipes or fittings (either finished products or not) originating in the People’s Republic of China bypassed final anti-dumping duties/141 by passing through Malaysia under the Implementing Regulation (EU) 2017 .
Implementing Regulation (EU) 2017/141 as amended by Implementing Regulation (EU) 2017/659 Final anti-dumping duties on imports of certain butt-welded stainless steel pipes and fittings (…) regardless of the origin of the finished product in the People’s Republic of China hereby applies to imported butt welding pipe fittings sourced from Malaysia, regardless of whether they are declared to be of Malaysian origin.
Two companies cooperating with the European Commission were granted immunity from findings of fraud. The expanded tariffs represent an anti-dumping duty of 64.9% that applies to “all other companies” in China.
Another EU case to combat circumvention of legislation regarding hot-rolled stainless steel produced in Indonesia and transported through Turkey is also currently at the final decision stage and will be announced shortly.
At the end of January 2023, the European Commission determined that hot-rolled stainless steel produced in Indonesia was evading anti-dumping measures through Turkey and announced an anti-dumping tax of 17.3% on all affected hot-rolled stainless steel. The European Commission is unlikely to hear objections from companies associated with Turkey and Indonesia, as well as a large Italian rolling mill. The request for release was categorically rejected.
The EU also announced today that it will consider the expiration of anti-dumping measures applicable to certain imported seamless stainless steel pipes originating in the People’s Republic of China.
The European Steel Tubing Association (ESTA) submitted the request for review on December 2, 2022. We warned in 2022 that this review was likely to take place and ESTA or EUROFER would not allow this measure to expire without comment.
